JAX Tyres & Auto- Local Membership Terms & Conditions
In order to support local businesses, your participating JAX Tyres & Auto store (subject to the below Terms and Conditions) would like to offer local businesses & their employees a JAX Tyres & Auto Local Membership entitling membership holders certain benefits when purchasing goods and services with a Participating Store (Local Membership).
The following Terms & Conditions apply as between the Member and the applicable Participating Store and govern any Local Membership including a Member’s access to, and ability to use, certain Local Membership benefits and offers.
General
- These Terms and Conditions may be varied by JAX from time to time.
- JAX will use reasonable endeavours to notify you of any changes to these Terms and Conditions by placing a notice on jaxtyres.com.au (the Website).
- You are bound by these Terms & Conditions which you accept at the time of becoming a Member.
Terms and Conditions
Eligibility
- Local Membership is open to all Eligible Businesses & their employees. An ‘Eligible Business’ for the purpose of these Terms and Conditions is a business with a registered Australian Business Number whose business address is located within a certain proximity (as determined by the Participating Store) from a participating JAX Tyres and Auto Store (Participating Store).
Applications for Membership
- An Eligible Business or an employee of an Eligible business becomes a member of Local Membership (Member) after an application for membership is received and approved by a Participating Store.
- A Participating Store may offer to any Eligible Business and/or its employees, the ability to apply for registration to Local Membership at any time or any Eligible Business and/or its employees may choose to apply to become a Member at any time after becoming aware of Local Membership.
- The application and approval process for Local Membership is determined by a Participating Store from time to time.
- Enquiries can be made in store at any time as to the current application for Local Membership.
- At all times, with any application for Local Membership, a Member must provide at least the following information to a Participating Store:
- Business name and ACN or ABN of the Eligible Business;
- Proof of employment at Eligible Business (including but not limited to company ID or business card)
- Address;
- Contact telephone number;
- Email address; and
- any reasonable information requested from time to time to confirm the identity of a Member or eligibility of a Member, (collectively referred to as Member Information).
- All Member Information will be held by a Participating Store in accordance with the Franchisee’s relevant privacy policy, a copy of which is available at (hyperlink) jaxtyres.com.au/privacy-policy (Privacy Policy). It is acknowledged that each Participating Store may disclose Member Information to any Related Body Corporate of the JAX group of companies including but not limited to JAX Quickfit Franchising Systems ACN 112 050 058 (JQFS). JQFS and/or a Participating Store will use, store and disclose any Member Information only in accordance with their relevant Privacy Policy.
Membership
- A Member will receive a Local Membership Card (an LM Card) once a Participating Store approves the application for Local Membership.
- Member Information and relevant LM Card number will be stored by a Participating Store in its Member Registry for the purposes of identifying the Member and its purchases, providing the Member certain discounts and for all other reasonable purposes associated with membership including but not limited to replacing any lost, stolen or damaged LM Card.
- A Member accepts and agrees to be bound by these Terms and Conditions, a copy of which is provided on the Website (as updated from time to time).
- To the extent of any inconsistency between these Terms and Conditions and any Participating Stores local terms, these Terms and Conditions prevail.
- Each Member is responsible for the safe keeping of their LM Card, and is fully liable for any and all use of the LM Card with purchases at a Participating Store whether such use is by a Member or by any person or entity not identifiable as the Member.
- A Member must contact the Participating Store if an LM Card becomes lost, destroyed or otherwise damaged so that it may no longer be used and/or the Member is aware of any unauthorized use of an LM Card by a third party.
- Each Participating Store reserves the right to:
- issue or re-issue a new LM Card; and/or
- at any time, cancel, revoke or otherwise suspend an LM Card; and/or
- disqualify the Member from access to any discounts associated with membership of Local Membership for any unreasonable or unconscionable behaviour and/or any other circumstances a Participating Store deems worthy of LM Card revocation/cancellation, at their sole discretion.
Membership Benefits and Access to Offers
- A valid LM Card provides a Member access to:
- 5% OFF tyres and any other service-related product upon purchase of tyres including but not limited to rotation, balancing, wheel alignment, nitrogen inflation; and
10% OFF mechanical services related to the running of the vehicle included but not limited to battery, engine oil service, disc pad replacement purchased at a Participating Store at all times on presentation of a valid LM Card to a Participating Store (5 & 10% Discount); AND - any Participating Store Offer which may be available from time to time to a Member.
- 5% OFF tyres and any other service-related product upon purchase of tyres including but not limited to rotation, balancing, wheel alignment, nitrogen inflation; and
- A “Participating Store Offer” is an offer of discount and/or other benefit to a Member, which may be (but will not always be) available from time to time at a Participating Store, in respect of goods and services purchased at that Participating Store.
- A Participating Store Offer will be offered at the sole discretion of a Participating Store and there is no representation or undertaking of any kind by a Participating Store that any number of Participating Store Offers may be available to a Member at any time.
- A Participating Store may offer a Participating Store Offer:
- at any time;
- to Members recorded on its Member Registry;
- on any reasonable terms provided to a Member from time to time; and
- through advertising or otherwise promoting the Participating Store Offer in email or other communications to the Member or in store at a Participating Store.
- A Participating Store is not obliged to offer any Participating Store Offer offered by any other Participating Store which a Member otherwise becomes aware of. However, a Participating Store may (at its sole discretion) choose to match a Participating Store Offer of any other Participating Store.
- Any Participating Store Offer is subject to availability. The Participating Store reserves the right to decline, modify, suspend or terminate the Participating Store Offer without liability of any kind provided always it shall always provide a Member the 5 & 10% Discount. It is the Member’s responsibility to check with a Participating Store for details of an Participating Store Offer from time to time and any changes applying to that offer before making a booking with a Participating Store.
- The benefits associated with being a Member are not redeemable transferrable, exchangeable, for cash or able to be exchanged for any other goods or services, unless otherwise agreed and specified by a Participating Store. Any element of any benefit that is not claimed will be forfeited, and no compensation is payable in its place.
- (Hyperlink) JAX Commercial Terms of Supply for Goods and Services apply to the sale and purchase of all goods and services at a Participating Store, subject only to the deduction of a discounted sum from the total amount payable in accordance with those Terms of Supply which are provided by these Terms and Conditions.
Miscellaneous
- Except as these Terms and Conditions specifically state, a Participating Store does not include by implication any other condition, term or warranty in respect of the quality, merchantability, acceptability, fitness for purpose, condition or description of a service or product provided in the applicable Participating Store.
- Nothing in these Terms and Conditions is to be interpreted as excluding, restricting or modifying, or having the effect of excluding, restricting or modifying, the application of any State or Federal legislation applicable to the supply of goods or services that cannot be excluded, restricted or modified including but not limited to the Consumer Guarantees under the Australian Consumer Law.
- To the maximum extent permitted at law, JQFS and each Participating Store (and their respective agents, employees and officers) exclude all liability for any actions, claims, costs, demands, expenses, liabilities or loss (including any consequential or indirect loss) of any kind whatsoever arising from or related to the Local Membership.
- The laws of New South Wales from time to time governs these Terms, and Participants agree to the non-exclusive jurisdiction of the courts of New South Wales, the Federal Court of Australia, and courts entitled to hear appeals from those courts.
